Brian Flores' Lawyers Slam Unsealed Raiders Report as Racially Stereotyped Retaliation

A recently unsealed report from the recruiting firm Korn Ferry regarding Brian Flores has been criticized by his lawyers as containing multiple instances of "racial stereotypes" and representing unlawful retaliation for the coach's discrimination lawsuit against the NFL. The report, made public on Tuesday and obtained by The Associated Press, was first published by Front Office Sports and was compiled in connection with the Las Vegas Raiders' head coaching vacancy in 2024.

Flores, who is currently the defensive coordinator for the Minnesota Vikings, is a Black coach who sued the league and three teams in February 2022, alleging that the NFL's hiring practices are "rife with racism" against Black coaches. He was joined in the lawsuit by fellow Black coaches Steve Wilks and Ray Horton. The Korn Ferry report lists six strengths and seven weaknesses, which Flores' attorneys argue demonstrate that the league continues to rely on racial stereotypes in hiring and is unlawfully retaliating against him for his lawsuit.

Attorney Michael J. Willemin stated, "The recently unsealed documents demonstrate two unfortunate, but unsurprising, realities. First, that Mr. Flores' decision to hold the league and its teams accountable for systemic race discrimination has been met with unlawful retaliation. Second, discrimination continues to play a significant role in the hiring process for NFL Head Coaches, as evidenced by the fact that the candidate profile prepared for the Raiders leans heavily on racial stereotypes. We and Mr. Flores are committed to eradicating the institutional racism and retaliation that permeates the league, its teams and their partners." The NFL did not immediately respond to a request for comment.

Key Analysis

Among the strengths listed in the report, one states that Flores is a "polished and a good presenter despite growing up in Brownsville, Brooklyn (same as Mike Tyson). He was able to build a strong friendship with a billionaire's son which gave him opportunities to socialize and learn how to build relationships with white-collar and upper-class individuals." Brownsville is a predominantly Black and Hispanic neighborhood in Brooklyn. This characterization has been flagged by Flores' legal team as perpetuating racial stereotypes.

The report also lists several negatives, including that Flores "can fool you with his polish upwards. Has little people skills, lacks self-awareness and can sometimes exhibit erratic behavior." It references former Dolphins quarterback Tua Tagovailoa's statements, which the report claims opened a narrative that Flores was "pessimistic and adversarial" and that his style "shattered his confidence." Other negatives include that Flores' "personality is unpredictable" and that he "once threatened violence to his GM and made irrational demands during an ownership meeting." Additionally, a long-term senior executive is quoted as saying Flores "may have changed since, but he was the worst hiring decision we've ever made." The final negative point notes that the ongoing litigation related to Flores' discrimination case against the NFL could cause a distraction.

Flores had recently been fired from his head coaching position with the Miami Dolphins when he filed the lawsuit. The unsealed report and the subsequent allegations from Flores' attorneys add another layer to the ongoing debate about racial discrimination and hiring practices within the NFL.
